Terms of Service

These Terms of Service (“Terms”) govern your access to and use of NOTEPAD-ANON (“the Service”, “we”, “us”, or “our”), a free, anonymous, end-to-end encrypted note-sharing service. By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Description of the Service
NOTEPAD-ANON allows users to create short, encrypted notes that can be shared via a unique link. Notes are encrypted in your browser using AES-GCM before being transmitted. The decryption key is contained only in the URL fragment and is never sent to our servers. Notes are automatically deleted after they are read (burn-after-read) or when their configured expiry time elapses. We do not collect personal information, require accounts, or log IP addresses in connection with note content.
2. Acceptable Use
You agree to use the Service only for lawful purposes and in a manner consistent with all applicable local, national, and international laws and regulations. The Service is intended for legitimate purposes such as sharing sensitive credentials, personal notes, or private information securely.
You must not use the Service to:
- Upload, transmit, or share any content that is illegal under applicable law;
- Distribute malware, viruses, exploit code, or other harmful software;
- Facilitate harassment, threats, stalking, or abuse of any individual or group;
- Share child sexual abuse material (CSAM) or any content that sexually exploits minors — violations will be reported to the relevant authorities;
- Conduct or facilitate fraud, phishing, identity theft, or other deceptive schemes;
- Trade or distribute controlled substances, weapons, stolen data, or other contraband;
- Engage in or coordinate criminal activity of any kind;
- Infringe upon or misappropriate any third-party intellectual property, privacy, or other rights;
- Violate any export control or sanctions regulations;
- Circumvent, disable, or interfere with security features of the Service;
- Probe, scan, or test the vulnerability of the Service without our prior written authorisation;
- Engage in automated scraping, crawling, or abuse of the Service's APIs beyond normal use.
3. No Warranties — Service Provided “As Is”
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that notes will be available for any specific duration.
You use the Service at your own risk. We strongly recommend that you do not rely solely on the Service as the only copy or backup of critical data.
4. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NOTEPAD-ANON AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR ANY HARM RESULTING FROM CONTENT STORED OR TRANSMITTED THROUGH THE SERVICE.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO USE THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) TEN US DOLLARS (USD $10).
5. User Responsibility and Indemnification
You are solely responsible for all content you create, transmit, or share through the Service and for any consequences thereof. You agree to indemnify, defend, and hold harmless NOTEPAD-ANON and its operators, affiliates, and licensors from any claims, losses, damages, liabilities, costs, or expenses (including reasonable legal fees) arising out of or relating to:
- Your use of the Service;
- Your violation of these Terms;
- Your violation of any applicable law or regulation;
- Any content you submit through the Service.
6. Technical Limitations and No Access to Content
Because notes are encrypted client-side and we do not possess the decryption key, we technically cannot read, moderate, or recover the content of notes. This means:
- We cannot verify the content of notes and cannot act on reports of specific note content;
- We cannot recover lost or expired notes;
- We cannot produce note content in response to legal requests — we hold only ciphertext and metadata (note ID, expiry time, creation timestamp).
The fact that we cannot read content does not exempt you from legal liability for what you transmit. You remain fully responsible for complying with all applicable laws.
7. Termination and Suspension
We reserve the right to suspend or terminate access to the Service, or to remove any content, at any time and without notice, if we reasonably believe that you have violated these Terms or that your use poses a risk of harm to others or to the Service. Because notes are encrypted, removal is limited to deleting the stored ciphertext and blocking note creation from identified sources (e.g., IP address) where technically feasible.
8. Intellectual Property
The Service software, design, branding, and all associated intellectual property are owned by NOTEPAD-ANON or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose. You may not copy, modify, distribute, sell, or sublicense any part of the Service without our prior written consent.
You retain ownership of any content you create and share through the Service. By using the Service you grant us no rights to your content, as we do not have the technical ability to access it.
9. Privacy
We do not collect personal data in the ordinary course of providing the Service. Standard server infrastructure logs (e.g., HTTP access logs) may be retained for a short period for operational and security purposes and are not linked to note content. Please review our Privacy Policy (if separately published) for more detail. Your use of the Service constitutes acceptance of our data practices as described herein.
10. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which the operator is domiciled, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service that cannot be resolved informally shall be submitted to binding arbitration or, where arbitration is not enforceable, to the exclusive jurisdiction of the competent courts of that jurisdiction.
11. Changes to These Terms
We may update these Terms at any time. The effective date at the top of this page will reflect the date of the most recent revision. Continued use of the Service after any changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
12. Severability and Entire Agreement
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. These Terms constitute the entire agreement between you and NOTEPAD-ANON regarding the Service and supersede all prior agreements or understandings.
